Copyright & DMCA

IFN respects creators’ rights and shows only films it has a documented basis to show. To report a copyright concern about material on this website, email info@theindiefilmnetwork.com with “Copyright notice” in the subject line.

How IFN handles a concern

  1. IFN acknowledges your message within 2 business days.
  2. If the concern appears plausible, IFN may disable the film while it reviews.
  3. IFN checks its rights records for the film and, where appropriate, contacts the filmmaker or uploader.
  4. IFN restores the film only if it has a documented basis to show it, and tells you what that basis is.
  5. If the rights cannot be established, IFN removes the film permanently.

IFN keeps a record of each concern and the action taken. Receiving a request does not mean IFN has concluded that a film infringes.

What to include

  1. Your name, organization (if any), email, phone, and postal address.
  2. The work you own or represent: title, author, and a link if available.
  3. The IFN page or pages involved (full URL).
  4. Your relationship to the work: owner, authorized agent, or other.
  5. What you believe is unauthorized, and why.
  6. Any license or agreement you believe IFN is relying on, if you know of one.

Formal DMCA notices

If you are sending a formal notice under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512(c)(3)), also include your physical or electronic signature and these statements: “I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.” and “The information in this notice is accurate, and under penalty of perjury, I am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.” Do not knowingly submit materially false claims; the law may impose consequences.

Repeat infringement

IFN will stop accepting submissions from, and remove the films of, any filmmaker or account holder who is the subject of two or more copyright complaints that IFN determines were justified, or who knowingly misrepresents rights, in appropriate circumstances.

Important limitation

This page describes how IFN handles copyright concerns; it is not legal advice. IFN has not yet registered a designated DMCA agent with the U.S. Copyright Office and does not claim any statutory safe harbor. This page will be updated with the agent’s details once registration is complete.
