Legal draft

Terms of Use

Last updated September 30, 2026. These draft terms apply to your use of The Indie Film Network website.

Who we are

The Indie Film Network (“IFN”) is operated by Charlie Whitley, as a sole proprietor. IFN is a free film-discovery website; there is no charge to watch.

Acceptance and permitted use

By accessing or using this website, you agree to these terms, and the Privacy Policy is part of them. Checking an agreement box on an IFN form is your electronic acceptance. If you do not agree, do not use the website. Use the site lawfully and do not interfere with its operation, attempt unauthorized access, introduce malicious code, scrape, copy, or download films from the site except as their licenses allow, overload the service, or misuse its forms, links, or streams.

Age and authority

You must be at least 13 years old to use this website, and some films are intended for mature audiences. Film submissions must come from adults who are legally able to enter into these terms and who have authority to provide the project information and screener for the limited review described below.

Films on IFN

Films are shown on IFN under a Creative Commons license, a written license from the rights holder, or because they are in the public domain in the United States, as credited on each film page and on the Credits & Licenses page. Films remain the property of their owners. Nothing on IFN gives you rights in a film beyond those its license gives the public.

No affiliation or endorsement

Unless a film page says IFN has a written agreement with the film’s rights holder, IFN has no business relationship with the filmmakers, studios, cast, or crew of the films it shows, and none of them has sponsored, reviewed, or endorsed IFN. Showing a film, crediting its makers, or listing them on the Filmmakers & Studios pages does not mean otherwise. These profiles are informational: they credit the people behind each film using the film’s own credits and the filmmaker’s public pages. Names, titles, and trademarks belong to their owners and are used only to identify the films and the people who made them.

Requests from filmmakers and rights holders

If you made or own a film shown on IFN, you can ask IFN to remove it, correct its credit, or update or remove your profile, by emailing info@theindiefilmnetwork.com. Creative Commons licenses also let a licensor ask that their name be removed from a credit, and IFN will do so. IFN aims to act on these requests within two business days. To report copyright infringement, follow the Copyright & DMCA page.

Film submissions and review permission

You retain ownership of a submitted film and its materials. By sending a submission, you represent that you own or control the necessary rights, or are authorized by the rights holder, to provide the information and screener link for review. You give IFN permission to access and review the submitted materials solely to evaluate the project and communicate with you about it. This limited review permission does not authorize public display, broadcast, distribution, promotion, sublicensing, or other exploitation. Any such use requires a separate written license agreement signed by the appropriate parties. Submission does not guarantee acceptance, a response, broadcast, distribution, or payment. Do not send material you require IFN to treat as confidential unless IFN has agreed to that in writing.

Your responsibilities and prohibited content

You are responsible for the accuracy of the information you submit and for securing permissions needed to share the screener and related materials for review, including any rights in music, footage, performances, artwork, photographs, and trademarks. Do not send or link to material you do not have the right to share. Do not submit material that infringes anyone’s rights; is unlawful, defamatory, or harassing; sexualizes minors; contains malicious code; or is deceptive or harmful.

Copyright concerns

If you believe material on IFN infringes your rights, follow the process on the Copyright & DMCA page. IFN may disable material while it reviews a concern. A complaint alone does not establish infringement, and IFN may restore material when it has a documented basis to do so. IFN will stop accepting submissions from, and remove the films of, anyone who is the subject of repeated justified copyright complaints or who knowingly misrepresents rights.

Removal and termination

IFN may remove any content, decline any submission, or restrict anyone’s access to the website at any time, including where IFN believes rights are in doubt or these terms were broken.

Website content and intellectual property

Unless otherwise identified, the website’s text, branding, and design belong to IFN or their respective rights holders and may not be copied or used without permission except as allowed by law. Film titles, films, screeners, artwork, and other third-party materials remain the property of their owners. These terms do not transfer ownership of submitted works to IFN.

Third-party services and links

The site uses or links to third-party services, including Vercel, Resend, Microsoft 365, Upstash, jsDelivr, Bunny.net, and external websites. Those services are operated independently and are subject to their own terms and privacy practices. IFN is not responsible for third-party content, availability, or practices.

Availability and disclaimer

The website and its films and streams may change, be interrupted, or become unavailable, and films may be removed at any time. To the extent permitted by applicable law, the website and its content are provided “as is” and “as available,” without warranties that cannot be excluded by law. Nothing in these terms excludes or limits a right or liability that applicable law does not allow to be excluded or limited.

Limitation of liability

To the extent permitted by applicable law, IFN will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the website. This clause does not limit liability that cannot legally be limited.

Responsibility for your submissions

If you submit material to IFN, you are responsible, to the extent permitted by law, for claims arising from rights you represented you held but did not.

Changes, severability, and entire agreement

IFN may revise these terms as the website changes; continued use after revised terms are posted means you accept them to the extent permitted by law. If any provision is unenforceable, the remaining provisions continue to apply. These terms, the Privacy Policy, and any separate agreement signed with IFN are the entire agreement about their subject; a signed agreement controls where it conflicts with these terms. Questions may be sent to Charlie Whitley at info@theindiefilmnetwork.com.
